First things first, what is an attorney?

In the United States, on the other hand, all attorneys fall under the same category.

What about the power of attorney (POA)?

Power of attorney, also called a mandate in civil law systems, is an authorization that enables a person to act legally on behalf of another person. The former is called the agent or attorney-in-fact, while the latter is called the principal or granter.

Any person can become an agent, and no legal background is needed.The power of attorney can be given both in oral and written form, but some some legal purposes a written document is necessary.

For the sake of clarity, through out this website, whenever we use the word attorney we will be referring not to an agent, but specifically to attorneys at law and lawyers.

Do I really need an attorney?

In theory, each individual has the right to defend himself in a court of law. Most of the times, however, this behavior is not recommended. Attorneys are trained in the practice of law, and they know the procedures and rules of courts, so that they are in a much better position to represent you.

Obviously, you need to take into consideration the seriousness of the problem. It would be a waste of time (and money) to hire an attorney to fight a speeding ticket. You should be able to do that yourself.

Whenever there is something bigger than a speeding ticket at the stake, however, it would be a good idea to hire the professional advice of an attorney. Most attorneys will also offer some free consulting time, so if you are in doubt, just talk with one.

How do I select an attorney?

Notice that someone coming out of law school is not a legally qualified attorney yet. In order to be able to file legal pleadings the person will need first to be admitted by the highest court in his state. This process is usually administered by the local bar association.

First of all, therefore, make sure that your attorney is a member of the local bar association. Secondly, verify what kind of specialization he has. As you can find at the bottom of this page or on the sidebar of the website, there are several branches of law, and usually it is a good idea to hire an attorney specialized at the legal problem that you have at hand.

Most attorneys will carry out a preliminary interview to identify the legal questions involved and the relevant laws. This part should give you an idea of the experience of the attorney and his skills.
